8. FORCE MAJEURE

Definition of Force Majeure: Neither Divine Travel Experience (Pty) Ltd ("the Travel Agency") nor the Client shall be liable for any failure or delay in performing their obligations under this Agreement if such failure or delay is due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, government regulations or restrictions, war, terrorism, civil unrest, strikes, labour disputes, airline or transportation disruptions, supplier failures, or any other unforeseeable events that render performance impossible or impracticable ("Force Majeure Event").

8.1 Consequences of Force Majeure

If a Force Majeure Event occurs, the affected Party shall notify the other Party in writing as soon as reasonably practicable, specifying the nature of the event and its expected impact on the performance of obligations under this Agreement.

During the period of a Force Majeure Event, the affected Party shall be excused from performance to the extent affected and shall use all reasonable efforts to mitigate the impact and resume full performance as soon as possible.

If the Force Majeure Event continues for a period exceeding thirty (30) days, either Party may terminate this Agreement by providing written notice to the other Party. In such cases, any amounts due for services already rendered shall remain payable.

All deposits paid to Divine Travel Experience (Pty) Ltd are strictly non-refundable under any circumstances, including in the event of a Force Majeure Event. The Client acknowledges and agrees that deposits secure travel arrangements and administrative costs, and therefore cannot be reclaimed.

In the event that a Force Majeure Event results in the cancellation or modification of travel services, Divine Travel Experience (Pty) Ltd shall make reasonable efforts to secure refunds or alternative arrangements from suppliers. However, the Travel Agency shall not be liable for any costs, losses, or damages incurred by the Client because of the Force Majeure Event.

Any refunds or rebookings shall be subject to the policies of third-party suppliers, including airlines, hotels, and tour operators. Divine Travel Experience (Pty) Ltd shall not be responsible for any refusal or delays by third-party suppliers in processing refunds or rebooking requests.

The Client acknowledges that travel insurance is strongly recommended to cover unforeseen events, and Divine Travel Experience (Pty) Ltd shall not be responsible for losses not covered by such insurance.

This Force Majeure Clause shall apply to all bookings and services provided by Divine Travel Experience (Pty) Ltd and shall take precedence over any conflicting terms in this Agreement.
